Introduction
These Terms of Service (“Terms”) govern your access to and use of the YourCar marketplace, an online service operated on the Isle of Man that connects buyers with dealers and private sellers of vehicles. By creating an account or otherwise using YourCar, you agree to be bound by these Terms.
If you do not agree, do not use the service. These Terms sit alongside our Privacy Policy and Cookie Policy, which explain how we handle your data.
Our role: a marketplace, not a party to the sale
YourCar is a venue that lists vehicles and connects buyers and sellers. We are not a party to any sale and do not take ownership of, inspect, or take custody of any vehicle listed. Any contract for the purchase or sale of a vehicle is made directly between the buyer and the seller.
- We do not guarantee the accuracy of any listing or the condition of any vehicle.
- We are not responsible for completing a sale, arranging finance, or transferring title.
- We strongly recommend you inspect a vehicle in person and verify its documentation and history before you pay any money.
Eligibility: you must be 18 or over
You must be at least 18 years old to create an account, list a vehicle, place a bid, or contact a seller on YourCar. By using the service you confirm that you meet this requirement and that the information you provide is accurate.
Your account
To list a vehicle or contact a seller you must register for an account and verify your email address. You are responsible for keeping your credentials secure and for all activity that occurs under your account.
- The information you provide must be accurate and kept up to date.
- You may not share your account or impersonate another person.
- You may hold only one personal account unless we agree otherwise in writing.
Closing your account & deletion
You can ask us to delete your account and personal data at any time from Privacy & data in your account settings.
- Deletion begins a 30-day grace period. During this window your live listings are withdrawn and we stop sending you marketing, alert, and digest emails.
- You can cancel the deletion and reinstate your account any time in those 30 days simply by logging back in. At the end of the grace period the deletion is permanent and cannot be undone.
- Some records are kept, in a form no longer linked to you, where the law requires it (for example completed auction and payment records). We explain exactly what is retained, and why, in the Privacy Policy.
- Deletion may be blocked while you have an unresolved obligation: a held bidder deposit, a due auction invoice, or an active dealership membership. We tell you what to resolve first.
Listings & conduct
Sellers are solely responsible for the accuracy of their listings, including price, mileage, condition, and vehicle history. Listings must describe a genuine vehicle that is available for sale.
- No misleading, fraudulent, or duplicate listings.
- No prohibited, stolen, or improperly documented vehicles.
- YourCar may review, edit, or remove any listing that breaches these Terms.
Your content: photos and listing text
You keep ownership of everything you upload. Your photographs and the words you write about your vehicle remain yours. What you give us is permission to use them to run the marketplace and to advertise your listing, nothing wider.
By uploading photographs or listing content, you grant YourCar a non-exclusive, royalty-free licence to store, reproduce, adapt and display that content for the purposes set out below, for as long as we hold it, which lasts until you ask us to remove it or your account is deleted, not until your listing stops being advertised. Some of what this licence permits creates copies that cannot be recalled once made; Withdrawing your content below says which, and why.
What that covers, in practice:
- Showing your photos on YourCar, and, for dealership stock, on that dealership’s microsite.
- Resizing and compressing them so pages load, and removing the location and camera information embedded in the file: we strip that on upload so it is never published.
- Generating the preview card that appears when your listing is shared to a social network or messaging app.
- Producing downloadable image packs of your listing photos, with the YourCar logo, or your dealership’s logo, added to each photo. These packs exist so a listing can be shared elsewhere. While your listing is live, anyone who can open its page can download one: that means any visitor, not only you. Once a listing is sold, withdrawn or expired, the pack stops being offered.
- Sending your listing and its photos to third-party advertising and vehicle-listing channels. This applies to dealership stock only, and only where that dealership has connected the channel itself.
We do not sell your photographs, and we do not license them to anyone for a purpose unrelated to advertising your listing.
You must have the right to upload what you upload. If a photograph was taken by someone else (a previous seller, a manufacturer, a photographer you hired), it is your responsibility to have their permission. Upload only content you own or are licensed to use.
Withdrawing your content. You can withdraw a listing at any time. A withdrawn, sold or expired listing stops appearing in search, in browse, and in any advertising channel it was being sent to.
Recently sold. The one exception is a car that has sold. For 30 days from the sale it can appear in Recently sold on YourCar, on the home page and at /sold, as its main photo, its year, make and model, whether it sold through YourCar, and whether it was sold by a private seller, a trader or a dealer. It never shows your name, the price, or the date it sold, and on the sold listing page itself a private seller's or trader's name is no longer shown. After 30 days it drops out of that list. A withdrawn or expired listing never appears there, and neither does a sold one once you have asked us to close your account.
It does not disappear. The listing page itself stays reachable by anyone who already has the link; its image pack does not. Removing a listing from view is not the same as deleting it. If you want your photographs taken down, ask us and we will take them off your listing, and deleting your account does the same at the end of the grace period described in Closing your account above. Be aware that a photo file which has already been published may stay reachable at its original file address for a while afterwards: it stops being shown anywhere on YourCar, but the file itself is not destroyed the same day.
What we cannot do is recall copies that have already left. Photos already sent to a third-party channel, already downloaded by someone as an image pack, or held in a search engine or social network cache are outside our control: we ask channels to withdraw the listing, but we cannot promise what another person or company has already saved. This is worth knowing before you upload, not after.
Auctions & bidding
Where a vehicle is offered by auction, every bid you place is an irrevocable offer to purchase at up to your stated maximum. Bids cannot be withdrawn or lowered once placed. If you are the winning bidder when a lot closes, you are obliged to complete the purchase and pay the invoice within the stated payment window; failure to pay may result in forfeiture of your bidder deposit and suspension of your account.
- Sellers may not bid on their own lots, whether directly or through an associate, employee, or related account. Doing so (“shill bidding”) is blocked by the platform and is grounds for immediate suspension and removal of listings.
- A bid placed inside the anti-snipe window extends the closing time. The displayed closing time is final once it passes: bids after it are rejected.
- Bidder identities are masked publicly; your maximum bid is never displayed while you lead.
Detailed auction terms, including buyer's premium, deposits, and dispute handling, are being finalised and will be published here before auctions open to the public.
Disclaimers & liability
The service is provided on an “as is” basis. To the fullest extent permitted by law, YourCar excludes all warranties and is not liable for any loss arising from a transaction between users or from reliance on listing content. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
Changes & contact
We may update these Terms from time to time. Material changes will be communicated via the platform or by email, and continued use after an update constitutes acceptance. For any question about these Terms, contact us at support@yourcar.im.
